Case Study
Three 18th-century homes were being demolished and renovated by a contractor. Three of these were to be reconstructed with underpinnings, and the other two were to be completely dismantled. Both the Employer and the Contractor received a JCT 6.5.1 insurance. A portion of the brickwork in the property that was being renovated had plaster stripped from it, and soon after, some of the brickwork fell out of the chimney. After two weeks, cracks appeared, and the damage was severe enough to warrant the issuance of a dangerous structure notice and the eventual demolition of the building.
When professional engineers were consulted, their conclusion was that collapse was unavoidable even though it was not conceivably predicted. Consequently, indemnity was granted in accordance with JCT 6.5.1 policy.
£993,903 was the total claim amount, which also included £7,402 in expenses. £500,000 was awarded for demolition work and £393,000 for building work.
